Summer Nights Sweepstakes Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING.
1. Timing/How to Enter: Promotion begins July 22, 2005 and ends August 20, 2005 (the “promotion period”). You may enter online at www.summernights.org by completing an Official Entry Form on-site during a concert at Cingular’s promotional booth during the promotional period.
2. Participation: Promotion is open to legal residents of the 50 United States, D.C., Puerto Rico and the US Virgin Islands, 18 years of age or older, except for employees of Cingular Wireless, One Reel, Southwest Airlines, Marriott Hotel, Outback Steakhouse, Gibson Guitars and their immediate families (parent, child, spouse, sibling) and household members, their respective affiliated and parent companies, advertising and promotion agencies, the respective parents, subsidiaries, affiliates, directors, owners, employees and agents, and anyone involved in this promotion’s production, development or handling. This promotion is subject to all federal, state and local laws and regulations. Sweepstakes is void where restricted or prohibited by law.
3. Winner Selection and Validation: ONE (1) Grand Prize Winner will be selected in a random drawing on or about August 20, 2005 by a One Reel employee supervised by a judging organization, whose decisions are final on all aspects of the promotion. All entries are subject to validation by the judging organization. By entering, you agree to be bound by these Official Rules and all decisions of the judging organization. Potential winner will be notified and may be required to sign an Affidavit of Compliance with these Official Rules and a Publicity Release for use of his/her name, likeness, biographical information without further compensation unless prohibited by law. Failure to sign these forms may result in forfeiture of prize and selection of an alternate winner. Entry materials void if incomplete or if they contain errors. One entry per person. In the event the winner cannot be contacted or declines the prize an alternate winner will be contacted.
4. Prizes and Odds: One (1) Grand Prize consisting of: TWO (2) Southwest Airlines roundtrip ticket vouchers to Nashville, TN; ONE (1) Motorola Razr Phone with $100 Cingular service credit, TWO (2) nights stay at the Courtyard Marriott Hotel, ONE (1) free gift certificate for two to Outback Steakhouse and a tour of the Gibson Guitar plant. Approximate retail value of the Grand Prize is $3,250. Winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the event, unless otherwise indicated. No substitution, cash equivalent or transfer of prize permitted except at the sponsor’s option for a prize of comparable or greater value. All prizes must be redeemed by winner within one year from being notified. Should wireless services not be available in winner’s zip code area, a cash prize equivalent to the grand prize approximate retail value will be provided. Odds of winning depend on the number of entries received. Cingular Wireless reserves the right to make changes to the prizes or to the sweepstakes without notice.
5. Miscellaneous Conditions: If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners from among all eligible entries prior to the cancellation. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors.
Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and entrants further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State.
By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify Cingular Wireless, One Reel, Courtyard Marriott, Southwest Airlines, Outback Steakhouse, Gibson, and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.

7. Entrants Personal Information: Personal information collected from entrants will be retained for the duration of the promotion and then discarded after winners have been selected, except as noted below.
